Users may utilize this website by easily adding weblinks into a “clutterbar” and then sorting or categorizing them into “clusters” as the members so choose; and by accessing or sharing their links with others from a personalized URL at www.linkable.com/username. By accessing or otherwise using Linkable you agree and acknowledge to be bound by these Terms of Service ("TOS"). If you do not agree to the TOS or to our Privacy Policy, please do not use or access Linkable. Linkable reserves the right to change the TOS at any time. Linkable therefore recommends that you periodically review these TOS.

Linkable grants you a limited license to access and use Linkable in accordance with these TOS. Linkable reserves the right to terminate your license to use Linkable at any time and for any reason or to charge for commercial usage in the future.

You are solely responsible for your use of Linkable. Because Linkable merely serves as a repository of bookmarked weblinks of each Members’ own choosing, user-posted content does not represent the advice, views, opinions or beliefs of Linkable, and Linkable makes no claim of accuracy of any user-posted material. Linkable allows for the posting of links to third-party websites. The linked websites' content, business practices and privacy policies are not under the control of Linkable, and Linkable is not responsible for the content of any linked website or any link contained in a linked website. The weblinks added by Members to their individual pages on Linkable does not imply any endorsement by or any affiliation with Linkable. In accessing Linkable or following links to third-party websites you may be exposed to content that you consider offensive or inappropriate. You agree that your only recourse in this situation is to stop using Linkable. Users must use Linkable in a manner consistent with any and all applicable laws and regulations. Links that are placed on Linkable must not be associated with illegal activity and must follow guidelines of reasonableness. Linkable reserves the right to investigate and take appropriate legal action against anyone who, in Linkable’s own discretion, violates this provision, including but not limited to, reporting you to law enforcement authorities. Links associated with the following partial list of activities are prohibited: child pornography, fraud, trafficking in obscene material, drug dealing, prostitution, harassment, stalking, spamming, spimming, sending of viruses or other harmful files, copyright infringement, patent infringement, or theft of trade secrets. You understand that the creation of bookmarks on Linkable for purposes of specifically boosting exposure of a site in Linkable and/or search engines is a breach of these TOS, and that Linkable views such entries as spam. Linkable reserves the right to take appropriate action to restrict such entries up to and including termination of your access to Linkable.

By posting weblinks and bookmarks, you are granting permission to Linkable and others to access and use that content in connection with Linkable and otherwise in connection with its affiliates’ businesses. Users’ links are accessible by the public if not set in the privacy tab provided. Each User has a privacy tab that can only be accessed with a 4-digit privacy personal identification number. Users may use this privacy tab to store the links and clusters that they wish to keep hidden from public viewing. Linkable does not and cannot control who has access to public weblinks. In addition, Linkable is explicitly not responsible for the manner or circumstances by which third parties access or use the weblinks you have chosen to make public and is under no obligation to disable or otherwise restrict this access. Linkable provides you with the ability to retrieve and remove your posted content and your personal information from Linkable. This ability does not extend to copies that others may have made or to copies that Linkable may have made for backup purposes. In all cases, Linkable disclaims liability for confidential links or information of a personal nature that may be exposed to the public via Linkable.

Linkable, the Linkable logo and the Linkable design are all the trademarks or trade dress of Linkable, LLC, and may not be used without express written permission from Linkable, LLC other than for attribution. All other trademarks not owned by Linkable, LLC that appear on Linkable are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Linkable, LLC. Linkable-originated content included on the Site, such as text, graphics, logos, data compilations, software and the compilation of all content on the Site, is the property of Linkable and its licensers and protected by United States and international copyright laws. LINKABLE PROVIDES THIS SITE AND SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. LINKABLE SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, INFORMATION ACCURACY, INTEGRATION, INTEROPERABILITY OR QUIET ENJOYMENT. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. You understand and agree that you use Linkable at your own discretion and risk and that you will be solely responsible for any damages that arise from such use. You agree to indemnify and hold Linkable, its subsidiaries, and affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Linkable in violation of this TOS and/or arising from a breach of this TOS and/or if any content that you post on the this Site causes Linkable to be liable to another.

Linkable and you are independent entities, and nothing in the TOS, or via use of Linkable, will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between Linkable and you. These TOS supersede any previous agreement related to your use of Linkable and represent the entire agreement between Linkable and you with regard to your use of Linkable. These TOS are governed by the laws of the State of California without reference to conflict of laws principles. In the event of a dispute between you and Linkable concerning these TOS, you agree to exclusive personal jurisdiction and venue in the state and federal courts of the United States located in the State of California , City of San Francisco. If any provision of the TOS is adjudged to be illegal or unenforceable, the continuation in full force of the remainder of the TOS will not be prejudiced, and the illegal or unenforceable provision of the TOS shall be severed accordingly.
